The Evolution of E-Discovery: Technology, Rulemakeing and the Impact of Best Practices [Top]

Thomas Y. Allman
Former Senior Vice President and General Counsel
BASF Corporation

The explosive growth of electronic discovery has been channeled by the Federal Amendments of 2006 and is now the subject of an intense debate across the country as states scramble to catch up! Clearly, some of the emerging issues require a more nuanced approach than the Federal Amendments – and experience suggests that both the "accessibility" and the "safe harbor" rules can be successfully modified to play that role. Tom Allman, a keen observer and a participant in both the "best practices" and rulemaking movements, will discuss current developments – including the Second Edition of the Sedona Principles, which he helped edit – at the heart of this new paradigm. You will walk away well prepared to reinforce positive change and provide effective leadership in the e-discovery challenges ahead of us.

Our experts give you some interesting and unique tips on using mobile, remote and wireless technologies.

AT3: The Move To Office 2007 – Emerging Best Practices

Law firms are facing a big question – when should we move to Office 2007? Once a simple boxed suite of desktop applications, the 2007 Microsoft Office system is a full-fledged platform that reaches far beyond the desktop and even the enterprise. Follow the journey of Office 2007 early adopter law firms – from their decision criteria to the latest best practices for implementing Office 2007 successfully. Take away practical strategies for planning your own successful Office 2007 migration.

Knowledge Management [Top]

Knowledge Management (KM) has evolved from a set of interestin theories to practical approaches that deliver real value. As KM continues to evolve, so must your organization's strategic plan in order to maintain a successful and effective KM discipline. Learn what other organizations are doing to ensure that their KM initiatives thrive.

KM1: How Knowledge Management Has Grown Up

Knowledge Management arrived as a concept a number of years ago. But it has taken more time for viable commercial systems and approaches to deliver real value. This session explores:

KM2: Technology Integration – The New Face of KM

Early approaches to Knowledge Management tended to take one of two forms:

  1. Individual, highly customized systems;
  2. Commercial applications providing KM to the mass market.

Some organizations have moved to combine the two approaches in a technology integration that combines the best of both worlds. In this session, you will hear from leading law firms that have embarked on highly customized approaches that still integrate the best of what commercial systems have to offer.

KM3: KM Roundtable – Practical Approaches

Though Knowledge Management is not a new concept, many organizations struggle to find practical approaches that work for their specific needs. This panel features leading KM experts from large law firms committed to making KM a success. Find out about the particular approaches they've used to make their KM initiatives a success.

The Changing Role of Technology in Strategic Litigation Planning [Top]

In this track, legal professionals will learn strategies for using technology to connect and manage key areas such as discovery, case assessment and case analysis to gain more control over the litigation workflow, to manage increasing cost constraints and to improve strategic litigation planning.

SL1: Gaining Control - Making Discovery Work for You

Attendees will also learn how this approach mitigates discovery risks while more efficiently meeting agreed-upon discovery deadlines.

SL3: E-Discovery & Document Review: Best Practices for Saving Money & Developing Realistic Budgets

Managing document review and the costs associated with e-discovery pose two of the most significant challenges attorneys face today. Recent Federal Rules changes, combined with ever-growing volumes of email and other electronic data, are compelling corporate counsel to adopt more efficient and cost-effective ways of responding to discovery requests and regulatory investigations. This session will provide insight new strategies for controlling costs by leveraging advances in technology and streamlining the document review process.

Actionable E-Discovery [Top]

You've heard the theoretical discussions on e-discovery – now learn th actionable steps to manage it in a faster, defensible, cost-effective and strategic manner. These practical, interactive sessions will focus on how inside counsel and law firms can take control of the e-discovery process while adhering to industry standards such as the EDRM Model and The Sedona Conference.

AED1: Finding The Right Balance Of In-House And Outsourced E-Discovery Resources

As legal teams take more control of e-discovery, they're challenged with finding the right mix of in-house staffing and outsourced services to quickly and efficiently handle discovery matters. How can companies, law firms and service providers balance the need to keep costs low, yet have the right expert resources available at all times? How can legal teams, working across multiple organizations, ensure that processes are transparent, repeatable and defensible? This session will include examples of how leading e-discovery practitioners are managing these needs and also provide practical steps on how to assess, plan and implement an effective resources strategy.

AED2: Data Sampling: A Strategy For Predicting Discovery Costs & Developing Case Strategy

How can inside counsel forecast the potential electronic discovery and review expense for each matter? How can the cost of discovery and review be weighed against the risk? And, once the risk and costs are assessed, how do they impact case strategy? Learn how the practice of data sampling can help legal teams answer these questions. This session will provide a playbook for inside counsel and law firms as they assess e-discovery costs and risks and develop case strategy.

AED3: Navigating Data Privacy Issues For Multinational Data Collection And Review

More multinational corporations and their law firms are challenged with managing cross-border projects of data collection, hosting and review. What are the data privacy issues that U.S. legal teams need to be aware of when handling multinational cases? How do these privacy issues impact litigation? This session will highlight the key challenges and pitfalls of discovery for international litigation and provide inside counsel and law firm attendees with guidelines on developing an effective legal strategy that is in compliance with international regulations.

Total Evidence Management™ [Top]

As the volume of electronic data grows exponentially, success is critical to having a secure, foolproof process to manage evidence. Learn how Total Evidence Management (TEM™) effectively combines and organizes the myriad of analog and electronically stored information that is subject to discovery. This track defines TEM in the digital age and discusses how comprehensive electronic data discovery and production protocols can save time and money and potentially change a litigation outcome.

TEM1: Total Evidence Management (TEM™): A Winning Approach To Complex Litigation In The Digital Age

This session focuses on understanding Total Evidence Management (TEM™) and why it is imperative to have a TEM process in place to comply with the scope of ESI requirements spelled out in the FRCP revisions, the consequences to parties that have failed to produce discoverable ESI, and the role that TEM can play in mitigating risk. Hear from in-house attorneys on how they use TEM day-to-day and how TEM has helped them to be more prepared in strategizing their cases.

TEM2: Authenticating Digital Evidence

Avoid having your motion dismissed because of inability to lay a proper foundation for your electronic evidence. See how having a TEM methodology in place to prove the authenticity of your evidence will help you to prepare for and win your cases. There will be a mock authentication hearing re authentication of chain of custody and other foundational issues.

TEM3: Mock Presentation of 26(f), Meet And Confer & Rule 16 Hearing

This session will include a Fed. R. Civ. P. 26(f) "meet and confer" session between the parties where they will discuss the "claims or defenses" of their cases and arrange for initial disclosures regarding "electronically stored information" (ESI). They will discuss any issues relating to preserving, disclosure or discovery of ESI, form or forms of disclosure, procedure for the protection of privileged documents, and expedited discovery. The parties will address the form in which data should be disclosed, keeping in mind issues such as "kept in the usual course of business" and "translated into reasonably usable format", and whether reference to a database will be sufficient for disclosure purposes. This will conclude with a Rule 16 appearance before the Court to memorialize an agreed preservation order, inadvertent disclosure order, and possible form(s) of disclosure, and resolve any other open e-discovery issues. What are the critical factors to focus on before, during and subsequent to the conference?

recommind presents
ETA4: The Future of eDiscovery is Here: Computer-Expedited Document Review

The majority of costs along the eDiscovery spectrum – roughly 70% of the entire eDiscovery bill – are generated at just one step of the process: the document review phase. The solution to this incredibly costly and time-consuming challenge lies in automation; the more lawyers can utilize software to help them automatically categorize and "pre-code" documents along key parameters like responsiveness, privilege, priority and relationship to issues or subject codes, the more efficient and accurate the entire review process becomes. This benefits not only the client – with better service, lower legal bills and a better chance of winning the case – but the lawyer as well, with more efficiency, far greater capacity and better work product. eDiscovery has experienced dramatic change over the past 5-7 years; shouldn't your review tools keep up with these changes?

Craig R. Carpenter, Esq., is Vice President of eDiscovery Solutions and General Counsel at Recommind.
