authentication hearing re authentication of chain of custody and other
foundational issues.
TEM3: Mock Presentation of 26(f), Meet And Confer & Rule 16 Hearing
This session will include a Fed. R. Civ. P. 26(f) "meet and confer" session
between the parties where they will discuss the "claims or defenses" of
their cases and arrange for initial disclosures regarding "electronically
stored information" (ESI). They will discuss any issues relating to preserving,
disclosure or discovery of ESI, form or forms of disclosure, procedure
for the protection of privileged documents, and expedited discovery. The
parties will address the form in which data should be disclosed, keeping
in mind issues such as "kept in the usual course of business" and
"translated into reasonably usable format", and whether reference to
a database will be sufficient for disclosure purposes. This will conclude
with a Rule 16 appearance before the Court to memorialize an agreed
preservation order, inadvertent disclosure order, and possible form(s)
of disclosure, and resolve any other open e-discovery issues. What are
the critical factors to focus on before, during and subsequent to the
conference?
